TMZ obtained documents in Halle Berry’s child support case in which the actress seeks to reduce her monthly child support payment to her ex boyfriend, Gabriel Aubry, from $16,000 a month to just $3,800 a month. We heard a couple of weeks ago that Berry sought to have her monthly payment reduced, and now there are more details in the case. Berry and Aubry share 50/50 custody of their daughter, Nahla, 6. Aubry is a male model who used to command top dollar from brands such as Valentino, Versace and DKNY. He’s fallen on hard times lately and in recent court documents says that he suffered six months without work following a Thanksgiving, 2012 beatdown from Halle’s then-fiance now-husband, Olivier Martinez, which injured his face. Halle claims that he’s a freeloader, essentially, and that he’s not working because he gets enough to live on from her substantial child support. Here’s some of TMZ’s report.

TMZ has obtained documents filed in their never-ending custody and support war. We broke the story … Halle is trying to reduce Gabriel’s child support for 6-year-old Nahla from $16K a month to around $3,800 a month.
Gabriel refers to the Thanksgiving day fight in Halle’s driveway back in 2012, in which he accuses Olivier Martinez of a sneak attack that pulverized his face. He says it took him 6 months to heal before he could possibly work again, and since then he’s only gotten 3 gigs.
But we checked out photos of Gabriel, and just 6 weeks after the fight there’s barely a sign of injury.
Halle attacks Gabriel as a deadbeat who is using child support to avoid having to work. She says, “There is no case, no law, no logic that says a healthy, active man gets to simply live off child support that the wealthier mother earns.”
And in Halle’s docs, her lawyer, Steve Kolodny, says Gabriel uses monthly child support for his own needs, including:
$740 a month for Gabriel’s “Fitness”
$940 a month in clothing (Gabriel lists Nahla’s clothing expenses separately — $675 a month)
$700 a month for Gabriel’s health insurance
$1,975 a month in car expenses
$1,100 a month in furniture and electronics
Imagine if the genders were reversed and Aubry was a woman who was injured by her ex’s girlfriend and was no longer able to work as a model. There would be much more sympathy for that side. Plus there’s no way to tell from photos that Aubry looked acceptable for modeling 6 weeks after the injury. Looking fine in paparazzi photos and having the ability to model professionally are two different things. TMZ is firmly in camp Halle because she’s their source.
Meanwhile, a source close to Halle tells People Magazine that Halle “does feel that he is abusing the system and taking advantage of her. Halle does work hard for her money, and it’s not easy for her to juggle the two kids with her work schedule. It’s understandable that she feels Gabriel should be able to make enough money to support Nahla.” Surely there’s some kind of balance here where Aubry can work more than he does and Halle can pay him somewhat less without reducing his yearly child support payment to just $45k a year. That’s a drop in the bucket to her. This isn’t about what’s best for Nahla, it’s about Halle sticking it to her ex. Child support is determined by the income of the wealthier parent, not by some arbitrary system where someone’s expenses are nitpicked.
